Should the Court Hear AKP Ban Case? Yes and No
The rapporteur for the Constitutional Court has released a 70-page opinion on whether the court should hear the case that has been brought against the ruling AK Party. The indictment accuses the party of trying to undermine secularism and proposes banning the party. The rapporteur’s opinion was yes — and no.
Citing Article 174 of the Code on Criminal Procedure (CMK), the rapporteur wrote that submitting an indictment without presenting concrete evidence about the accused might lead to a rejection of the case by the court, and pointed out that some of the evidence presented were speeches made by AKP members before the party was established. However, if the CMK was not taken into consideration, the Constitutional Court would have to accept the indictment.
The 11 member Constitutional Court could meet as early as Monday to discuss the report. (click here for news analysis)
