Is There A Way Out of The Swamp?

The escalating tensions between the judiciary and the government has landed both parties in a swamp of accusations and confrontations…. In an unexpected and harsh statement issued last week, the Supreme Court of Appeals accused the government of attempting to influence the judiciary and cripple the Republic. The government responded immediately, describing the move as legally baseless….

In search of a way out of the quagmire, many political figures and representatives of nongovernmental organizations point to the need of change in the attitude of both sides, with clear emphasis on the ruling Justice and Development Party (AKP) taking responsibility for its actions….

If government does not step back, it will be in considered wrong even where it has reason, Abakay said, noting that it is the government that prepared ample ground for the judiciary to act outside of its constitutional boundaries…. The real question is whether the government wants democratization, or to focus democratization discussions only on specific subjects…

[On the other hand]…A recent poll showed that half of the judges consider laws are petty details when it comes to the protection of the state. Judges and the judiciary must take all their references from the law…
